Ahead of the 2022 election, on July 12, the ACLU of Kansas sent every county election office in the state an informational letter about the potential for electioneering at polling locations located in religious institutions. The letter discusses that while religious institutions are able to display signage for or against the August 2nd constitutional amendment on the ballot on their property, consistent with their 501(c)(3) status, that allowance changes when they become polling locations. At that point, such institutions must comply with prohibition of any signage or other materials within 250 feet of the entrance to the polling location or within the facility while it is serving as a polling location.
The ACLU of Kansas has urged all county election offices to speak proactively with any institutions that may meet the above description and ensure they understand the need to remove all signs and materials advocating for any position on the constitutional amendment.
